These Terms of Service govern your use of the HO Scale website and your purchase of products from HO Scale.

Throughout these Terms, “HO Scale,” “we,” “us,” and “our” refer to the operator of this online store. “You” and “your” refer to anyone who visits our website, creates an account, or purchases a product from us.

By accessing our website or placing an order, you agree to these Terms of Service, our Shipping Policy, Return and Refund Policy, and Privacy Policy.

1. Online Store Terms

You must be legally capable of entering into a binding agreement to use this website or make a purchase.

You may not use our website or products for any unlawful, fraudulent, or unauthorized purpose. You may not interfere with the security, operation, or functionality of the website.

We reserve the right to refuse service, cancel an order, limit quantities, or restrict access to the website when reasonably necessary.

2. Products

HO Scale sells physical HO scale model railroad buildings, industrial structures, accessories, and related products.

Many products contain small, delicate parts. Our models are intended for model railroad hobbyists and collectors and are not intended to be used as children’s toys.

Product colors, surface textures, dimensions, and details may vary slightly because of differences in 3D printing, production methods, materials, lighting, photography, and computer displays.

Minor production marks, layer lines, support marks, or other characteristics associated with 3D printing are not necessarily considered defects.

Product dimensions and descriptions are provided as accurately as reasonably possible. Customers are responsible for reviewing the product description and confirming that the product is suitable for their layout before purchasing.

3. Product Photos and Representations

We make reasonable efforts to display our products accurately. However, your finished product may have minor differences from the product shown in photographs.

Scenery, vehicles, railroad equipment, figures, landscaping, track, lighting, and other display items shown in product photos are not included unless specifically stated in the product description.

All advertising and product listings use photographs created or authorized by HO Scale. We do not use another designer’s original product photographs unless we have received permission to do so.

4. Intellectual Property and Model Designs

All website content, product photography, written descriptions, logos, graphics, branding, and other original store content are owned by or licensed to HO Scale and may not be copied, reproduced, distributed, or used commercially without written permission.

Some of the physical models sold by HO Scale are based on designs created by independent model designers. HO Scale has received explicit commercial approval or permission from these designers to manufacture and sell finished physical versions of their models.

The original designer retains ownership of their underlying design and intellectual property unless otherwise agreed in writing. When appropriate, the original designer may be identified or credited in the applicable product listing.

Purchasing a physical product does not transfer ownership of or grant rights to any underlying digital file, 3D model, design, photograph, or other intellectual property.

Customers may not scan, duplicate, reverse engineer, digitally reproduce, manufacture, distribute, or commercially sell copies of our physical products or the underlying designs unless they have received separate authorization from the applicable designer or rights holder.

HO Scale does not sell, share, or redistribute any designer’s original digital files unless expressly authorized to do so.

5. Prices and Payments

All prices are listed in U.S. dollars unless otherwise stated.

We reserve the right to change product prices, promotions, availability, and product descriptions at any time. Price changes will not affect an order that has already been accepted and paid for unless there was an obvious pricing or listing error.

Payment is due in full at checkout. Orders will not enter production or fulfillment until payment has been successfully processed.

You agree to provide current, complete, and accurate billing, shipping, and payment information.

Taxes may be collected when required by applicable law.

6. Orders

Submitting an order does not guarantee acceptance.

We reserve the right to reject or cancel an order because of product availability, suspected fraud, payment problems, listing errors, production limitations, or other reasonable business concerns.

If we cancel an order after payment has been collected, we will issue a refund for the canceled portion of the order.

We may limit the number of products purchased by an individual, household, account, payment method, or shipping address.

7. Pre-Launch and Made-to-Order Products

Products marked as “pre-launch,” “preorder,” or “made to order” require production before shipment.

Pre-launch products have a build time of up to 30 days beginning on the date the order is placed. Shipping transit time is separate from the build time.

The stated build time is an estimate and may be affected by order volume, material availability, equipment maintenance, production complications, weather, carrier interruptions, or other circumstances outside our reasonable control.

If we are unable to complete or ship an order within the stated timeframe, we will contact the customer with an updated estimate and provide any cancellation or refund options required by applicable law.

Pre-launch and made-to-order products cannot be canceled or returned after production has begun, except when required by law or when the product arrives damaged, defective, or incorrect.

8. Shipping

We provide free standard shipping on all eligible orders unless otherwise stated during checkout.

Customers are responsible for providing a complete and accurate shipping address. We are not responsible for delays or delivery problems caused by incorrect or incomplete information provided by the customer.

Shipping timelines are estimates and are not guaranteed. Carrier delays, weather, holidays, and other events outside our control may affect delivery times.

When an order contains both pre-launch and ready-to-ship products, the entire order may be held and shipped together after the pre-launch product has been completed.

Customers should contact us promptly if a package is lost, damaged, or marked as delivered but cannot be located.

9. Returns, Refunds, and Restocking Fee

Eligible returns must be requested within 30 days of delivery.

Returned products must be unused, unassembled, unpainted, unmodified, and in their original condition and packaging.

All approved returns are subject to a 25% restocking fee. The restocking fee will be deducted from the amount refunded to the customer’s original payment method.

The restocking fee does not apply when a product arrives damaged, defective, or different from what was ordered.

Customers are responsible for return shipping costs unless the product arrived damaged, defective, or incorrect.

Products that have been assembled, painted, glued, cut, modified, or damaged after delivery are not eligible for return.

Custom, personalized, clearance, final-sale, digital, pre-launch, and made-to-order products may not be returnable as explained in our Return and Refund Policy.

Please contact us before sending a return. Returns sent without prior approval may not be accepted.

10. Damaged, Defective, or Incorrect Products

Customers should inspect their order promptly after delivery.

Claims involving damaged, defective, missing, or incorrect products must be submitted within seven days of delivery.

The customer should provide the order number and clear photographs of the product, packaging, and shipping box.

Depending on the circumstances, we may provide replacement parts, a replacement product, a refund, or another appropriate resolution.

We are not responsible for damage caused after delivery by improper handling, assembly, painting, gluing, modification, storage, installation, or use.

11. Product Assembly and Use

Some products may require assembly, finishing, painting, trimming, fitting, or gluing.

Customers are responsible for using appropriate tools, adhesives, paints, protective equipment, and safe work practices.

Always follow the instructions and safety warnings provided by the manufacturer of any tool, paint, adhesive, or finishing product.

HO Scale is not responsible for damage caused by improper assembly, modification, painting, installation, handling, or use of incompatible materials.

12. Optional Tools and Third-Party Services

Our store may provide access to third-party tools, payment processors, applications, websites, or services.

We do not control every third-party service and are not responsible for its availability, content, security, policies, or performance.

Your use of a third-party service may be governed by that provider’s own terms and privacy policy.

Shopify provides the ecommerce platform used to operate our store, but purchases made from this store are transactions between the customer and HO Scale.

13. Reviews and Customer Content

When you submit a review, photograph, comment, suggestion, or other content to us, you confirm that you have the right to submit it.

You grant HO Scale permission to display, reproduce, edit, and use submitted content in connection with operating and promoting the business unless otherwise agreed in writing.

Submitted content must not be unlawful, threatening, abusive, deceptive, defamatory, obscene, or infringing upon another person’s rights.

We may remove customer content that violates these Terms.

14. Prohibited Uses

You may not use the website:

• For unlawful or fraudulent purposes

• To violate intellectual property rights

• To submit false or misleading information

• To transmit viruses, malicious code, or harmful software

• To collect another person’s information without authorization

• To interfere with the website’s security or operation

• To scrape, copy, or reproduce website content for unauthorized commercial purposes

• To impersonate another person or business

• To attempt unauthorized access to customer accounts or store systems

15. Errors and Inaccuracies

Occasionally, the website may contain typographical errors, incorrect product details, inaccurate pricing, inventory errors, or other omissions.

We reserve the right to correct errors, update information, or cancel affected orders.

When an order is canceled because of our error, amounts paid for the canceled item will be refunded.

16. Disclaimer of Warranties

To the maximum extent permitted by law, the website and its content are provided on an “as available” basis.

We do not guarantee that the website will always operate without interruption, delay, or technical error.

Nothing in these Terms excludes or limits any warranty, right, or remedy that cannot legally be excluded under applicable consumer protection law.

17. Limitation of Liability

To the maximum extent permitted by law, HO Scale will not be liable for indirect, incidental, special, punitive, or consequential damages arising from the use of the website or products.

Where liability cannot be excluded, our total liability relating to a product or order will not exceed the amount the customer paid for the product giving rise to the claim, except when applicable law requires otherwise.

These limitations do not apply to liability that cannot legally be limited or excluded.

18. Indemnification

To the extent permitted by law, you agree to indemnify and hold HO Scale harmless from third-party claims, losses, damages, and reasonable expenses arising from your unlawful misuse of the website, infringement of another party’s rights, or material violation of these Terms.

19. Privacy

Your submission of personal information through the store is governed by our Privacy Policy.

Payment information may be handled by Shopify, payment processors, banks, and other third-party service providers necessary to complete your transaction.

20. Changes to These Terms

We may update these Terms of Service periodically.

The latest version will be posted on this page with an updated effective date.

Changes apply prospectively and do not alter rights or obligations relating to orders completed before the updated Terms took effect unless required by law.

Your continued use of the website after updated Terms are posted constitutes acceptance of the revised Terms.

21. Severability

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law.

The remaining provisions will remain in effect.

22. No Waiver

Our failure to enforce any provision of these Terms does not waive our right to enforce that provision later.

23. Entire Agreement

These Terms, together with our Privacy Policy, Shipping Policy, Return and Refund Policy, and any other policies posted on the website, constitute the agreement between you and HO Scale regarding your use of the store and purchase of products.

24. Governing Law

These Terms and any transactions involving HO Scale are governed by the laws of the State of Oregon and applicable federal law, without limiting any mandatory consumer protections available under laws that apply to the customer.
